<content:encoded><![CDATA[<p>I was part of a twitter conversation the other day with @penguin and @geekgiant were we discussed how frustrating it is to go to a new service and have you "go-to" username already taken.  It seems to me that something like OpenID should have a username registry where you could reserve a username much like you would reserve a domain name.  Then any services that work with OpenID would have to query the username registry before allowing someone to pick a username.</p>
<p>I think such a service is becoming more and more desirable.  With the rapid rise of Social Media many people have essentially developed brand equity or "self-equity" with their usernames.  Think of twitter and all of the 'twitter-lebrities'.  Imagine if someone was able to register @scobelizer or @laughingsquid on the next up and coming social network, there is some equity to be had which may even translate into a monetary transaction for the rightful person to own their identity.</p>

<p>A Tale of Two UDRP's<br />

<p>I have recently had some involvement with two proceedings under the Uniform Dispute Resolution Policy ("UDRP"), a procedure for deciding trademark disputes about domain names. The International Corporation for Assigned Names and Numbers ("ICANN"), which controls the system of assigning domain names, requires all domain name registrars to force domain name registrants to submit themselves to the UDRP as a condition of registering a domain name. These two proceedings help illustrate the bias of the UDRP against those who register domain names to criticize trademark holders, and the resulting lack of utility of the procedure to resolve cases in which the “griper” is determined to defend himself.</p>
<p>Curt Manufacturing Objects to George Sabin’s Gripe Site</p>
<p>One case involves a web site established by George Sabin, a Californian, to complain about a piece of equipment made by Curt Manufacturing Company of Eau Claire, Wisconsin that had caused injury to one of his friends. He used that domain name because it accurately reflects the subject of his web site. Curt filed a UDRP complaint alleging that the domain name curt-mfg.com violated its trademark rights. The complaint was filed in the face of many decisions of federal courts in the United States holding that a non-commercial “gripe” site about a trademark holder may use a domain name in the form www.trademark.com so long as the site itself is not confusing about whether it is sponsored by the trademark holder. After all, trademark law should not be available to suppress the speech of those who use trademarks truthfully to express their views about the trademark holder.</p>
<p>Sabin filed a response to the UDRP complaint which pointed out the many court decisions in his favor. In fact, he pointed out that Arizona, the location where the complainant had agreed to accept court jurisdiction in the event that these was an objection to the UDRP decision, is part of the Ninth Circuit, which had a controlling case on point, Bosley Medical v. Kremer.</p>
<p>However, the panelist appointed by the National Arbitration Forum, Joel Grossman, applied “his own brand of justice” and completely ignored governing federal law. Instead, he cited a handful of other UDRP decisions (a minority view even among UDRP decisions) that took domain names including trademarks away from the gripe site host on the ground that only domain names that combine the trademark with a word like “sucks” are permissible.</p>
<p>Under Rule 4(k) of the UDRP, the only way for a domain name registrant who loses a UDRP proceeding to prevent the transfer of the domain name to the complainant is to file suit within ten business days, but only in the “jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure [governing UDRP cases].” Because a complainant generally has the choice between submitting to court jurisdiction where the domain name registrant is located, or where the domain name registrar is located, complainants usually try to make it harder for the registrant to get to court by choosing the location where the domain name registrar is located. Sure enough, in this case Curt Manufacturing had opted for Arizona, not California, and Sabin did not know any lawyers who might help him in Arizona. It was only with difficulty that he managed to get a pro se complaint on file in Arizona by the deadline. Assuming that Sabin is able to find counsel in Arizona, he will have a strong claim for attorney fees under Ninth Circuit trademark law because under Bosley, Curt’s trademark claims are entirely groundless.</p>
<p>The Machinists Object to Gary Leatherman’s Gripe Site</p>
<p>A few days later, I received a request for assistance from Gary Leatherman in opposing a similar UDRP complaint by the Machinists union against his gripe site about a Machinists local. We had to recognize that the WIPO panelist might ignore the law just at the Arbitration Forum panelist had, making the submission of a response in the UDRP a waste of time. Moreover, the decision in the Fourth Circuit (where the Machinists’ Maryland headquarters is located) allowing gripe sites with domain names that use the trademark of the griping target, Lamparello v. Falwell, is even stronger than Bosley.</p>
<p>So, I contacted the lawyer representing the Machinists, Robert Kenney. Because Kenney, an IP lawyer from Virginia, claimed not to even know about the Lamparello case (which had come out of Virginia), I was concerned that he might not appreciate how untenable his position was. Or, perhaps, he was just happy to bill his client for his services regardless of how untenable his position was, a position I did not share since my own view is supportive of the labor movement. So I contacted an old friend in the Machinists’ legal department, and the UDRP complaint was promptly withdrawn.</p>
<p>The Increasing Disutility of the UDRP</p>
<p>In some ways, it is a pity that those who use trademarks to identify web sites that are about the trademark holder cannot count on the UDRP to protect their free speech rights. The UDRP has the advantage of being relatively cheap and expeditious. The problem is exacerbated by the fact that the complainant gets to decide which of several providers of dispute resolution services to ask to appoint a panelist. As a result, dispute providers have an incentive to adopt rules and to appoint panelists that favor complainants. The bias of the UDRP in favor of trademark holders is a longstanding problem, discussed several years ago in the paper Rough Justice by Syracuse University Professor Milton Mueller.</p>
<p>Perhaps, however, if trademark holders learn that they will no longer be able to rely on the UDRP so long as its panelists refuse to follow governing trademark law and First Amendment rulings from the federal courts, they will have reason to bring their complaints only to dispute resolution providers that require their panelists to follow the law.</p>

<p>Actually, <em>it</em> wasn't missing... only the domain name was.</p>
<p>Some of you <a href="http://en.wikipedia.org/wiki/Nancy_Drew" target="_blank">Nancy Drew</a>-types (and those like Nancy's boyish friend <a href="http://en.wikipedia.org/wiki/Nancy_Drew#Nancy.27s_friends" target="_blank">George,</a> of course) were able to find your way home.</p>
<p>But I know others sat scratching their heads, wondering why I would suddenly post lists of links to urine-kink and midget-sex sites. (I know <em>I </em>spit out my tea on Tuesday morning!)</p>
<p>Through a series of haps and mishaps, my domain name ended up in the sticky virtual hands of a guy in <a href="http://en.wikipedia.org/wiki/Serbia" target="_blank">Serbia</a>. A series of emails and $40 US dollars later, and I'm back to being Geek Porn Girl.</p>
<p>Ironically, I've been contemplating a name change for a couple of months now. The "porn" in GPG started out as a joke. I wrote a story called "<a href="http://geekporngirl.com/2007/08/25/hello-world/" target="_self">Heavy Breathing</a>,"  with lots of geeky features and no sex... it held only the promise of solving higher math problems and crunching Wintergreen Lifesavers in the dark.  I wisecracked that these things alone could be porn for geeky girls like me, the kind who fog up their glasses drinking tea on lesbian first dates. I threatened to write a whole series of these stories, and eventually this site was born.</p>
<p>I never thought having "porn" in my name would be a big deal, I just thought it was funny (and secretly sort of sex-positive). But some people can't access the site on their work computers, some spam filters screen out my feeds, and another blogger wrote to say he'd only a post a comment from me on his site without my URL because his co-workers might be scandalized.</p>
<p>(I've guess always wanted to be a little scandalous... so that alone might be enough to make me keep the name.)</p>
<p>The biggest lesson: I've found out that having "porn" in your name is enough to make you a popular target for shady guys in small central European countries who run adult video networks.</p>
<p>So I made lists of possible domain names. I weighed the pros and cons of changing it. Finally I decided I'd try to fight for the right to my own familiar name. (This is starting to sound like a Movie of the Week, isn't it?)</p>
<p><a href="http://www.godaddy.com/" target="_blank">GoDaddy!</a> became my Underdog. I've never experienced customer service like they provide. I made at least five phone calls to customer service, tracking down my domain name, figuring out how to pay for it safely, getting it re-set up and pointed towards home, and I don't think I was on hold for five minutes <em>total</em>. I'm telling you, they were that good. They were also kind, helpful, and humorous, without the flat quality of most customer service androids.</p>
<p>I can't promise I'll never change the name. It still may happen as this site grows and morphs. But I will say, I am darn happy to have my name back. Apparently, I'm more sentimental about porn than I ever knew.</p>

<p>The name is an abbreviation for really simple syndication, the Internet technology used to subscribe to blogs and news sites. The name is held by Torex Retail Holding and, though it is parked, get 20,000 page views a month.</p>

<p>Torex has put rss.com up for sale with a $750,000 USD reserve. Sedo, the online market place for buying and selling web names will oversee its sale to its new buyer.</p>

<p class="MsoNormal">Ok, I made the last name up, but if you own a domain name, you probably have received a letter from a company with a similar name telling you you have to renew your domain name right away or risk losing it.  Or better yet that you need to register it as a .biz, .info, .org, .dot or a .areyoukiddingme extension.</p>

<p class="MsoNormal">Ok, again, I made the last one (or two) up.</p>
<p class="MsoNormal">
<p class="MsoNormal">If you used Network Solutions to registrar your domain name and you get a letter from Network Solutions, it is a pretty safe bet it is a legitimate letter that needs your attention.  But if your domain is registered with Network Solutions and you get a letter from a company you don't recognize saying you have to renew your domain right away, stop and check as it is likely a trick.  Just as if your bank is Wachovia, you are not going to get a letter from Sunbank to update your account.</p>

<p class="MsoNormal">The below screenshot is an example of one of these letters I have recently received.  It came from a company I have never done business with.  They are trying to trick me into changing my domain renewal service to them.</p>

<p class="MsoNormal">I get a lot of these letters, but of course when I think to do a blog posting about them, they are like that hovering salesman at the mall who suddenly disappears when you actually need assistance so I can't find any of them laying around.  But of course, most go into the trash.  If you have received a questionable domain renewal letter, please email it to me or fax it to me at 352-401-0353 and I'll review and maybe even update this posting with more screenshots (blocking any of your personal info).  If you really aren't sure of the validity of a domain name renewal letter - just call me at 1-800-709-3240 and I'll be glad to review it with you.</p>

<content:encoded><![CDATA[<p>Next lesson in my computer/internet school. This time I thought I'd cover blogging sites. When I first heard of blogging it seemed alien to me. Then I tried it and couldn't make it work, but eventually, I got the bug. Now I can't imagine not blogging when I feel inspired. Of course, blogging requires a blog site, or software and a website and most of all a blog platform.</p>
<p>My favorite blog platform is WordPress. Yay! I absolutely adore WordPress. WordPress.org and WordPress.com.</p>
<p>The difference is that WordPress.com is a sort of web hotel, where you get your WP blog hosted for free. It does mean you get fewer choices in blog themes, plugins, widgets etc. You might also have trouble directing your domain name to your WP blog. Domain name - well, properly that should be covered in a separate post, one about homepages, webspace and, well, domain names. I'm not going to do that though. This is it. Blogs and homepages covered in one single blog post.</p>
<p>The reason for that is that today, most people hardly know what a homepage is and have trouble creating one. Even as late as a year ago, I was stubbornly sticking to my homepage and wanted to program it myself, using an editor, naturally. I'm not that good with html programming. Then it hit me - why should I do all the ground work, when my 'thing' is writing, primarily, and to some extent, photography?</p>
<p>I have come to the conclusion, that while I would love to make a blog theme 100 % as I like it, there are so many themes out there, that I can be pretty content with one someone else made.</p>
<p>Anyway, back to the domain name. It doesn't have to be that expensive, if you want one. There's no reason why you should need one, but if you do want one, it's easy to get and won't cost you too much. Unfortunately, there's a catch. When isn't there? It could be a bit tricky, configuring it. I'm afraid I can't help you there, but there should be help available online.</p>
<p>You can also get a domain name for free. It won't be a 'real' domain name, but it will shorten your URL and make it easier to remember. Uni.cc and cjb.net are the ones I've tried. Both work fine.</p>
<p>For a homepage, you'll need webspace and if you don't mind ads, you can get some for free. If not, there should be web hotels that have reasonable prices. My family and I are lucky enough to have found one that doesn't charge much but offers a lot of space.</p>
<p>You'll also need a web editor. There are some available online for free. I can't tell you how good they are, because I haven't tried them, but I've been told they're quite good. Finally, you'll need an ftp program, unless your webspace offers a web based file upload option.</p>
<p>Let's get back to blogging. You'll still need webspace if you decide to get your blog software from WordPress.org and if you like, a domain name. The upside is you get to choose any theme you like and you can get plugins and widgets.</p>
<p>The main advantage of both WP types is the ease of updating, editing etc. It's a breeze compared to editing in a web editor. That's why I decided in favor of a blog, rather than an old-fashioned homepage.</p>
