Customer Protection Measure - The Non Sense of Network Solutions

This case is actually well known since January 2008, when everyone just started talking about it everywhere. In the beginning I just let this topic away from my site, for I thought that everybody surely had known about it, but it seems that newcomers would still come and stumble upon similar experience *again*, so I decided to bring this topic up here too.

For the newcomers of domain name registration, maybe some of you have known … but maybe some others of you haven’t known yet. So let’s make sure that all of us know the same information now.

There is a warning for all of you and I to note and to remember: Before you start searching availability of your chosen domain name to be, beware …

Network Solutions has implemented a program that locks users from registering domains with other registrars, they call it: “Customer Protection Measure”.

What the heck is that? How does it work?

The simple logic flow for easy understanding is:

1. You were searching the availability a domain name from Network Solutions domain searching interface.

2. You found they said that the domain you searched was available to purchase.

3. But, you didn’t purchase it right away (because their price was $34.99 and you knew that your registrar-to-be would offer you cheaper price, and even only around $9), and you decided to go to your registrar instead of purchasing it through Network Solution.

4. So you quickly visited your registrar page to register the domain name …

5. But you suddenly found out that the domain name was TAKEN and when you entered the domain name into whois query, you found something similar like this:

   Registrar: NETWORK SOLUTIONS, LLC.
   Whois Server: whois.networksolutions.com
   Referral URL: http://www.networksolutions.com
   Name Server: NS1.RESERVEDDOMAINNAME.COM

   (Note: ******* is censored, for the sake of the person -since this is a true story- who naively had searched this domain and now the domain was under ‘hostage’ for $34.99 ransom)

6. You quickly got back at Network Solutions page, checking the domain name again (either by the same searching interface or by using their whois tool), and you found that the domain was still available there! But it was only available to be purchased right there, from the Network Solutions only.

7. And later you finally realized, there was a small image (almost unnoticed) on the same searching page, when you clicked it, it would bring you to a page explaining about the so-called Customer Protection Measure of Network Solutions, saying something like this:

“Network Solutions may reserve domain names that are searched on our Web site for up to 4 days. During this period, these domain names will only be available to register at networksolutions.com.”

No matter what some defenders said about the so called Customer Protection Measure, including their response about this case (read Network Solutions responds to Front Running Accusations at domainnews.com), whatever they said, it is clear that what they implement is no difference with their own definition of Front Running:

Front Running is when an individual registers domains within minutes or hours after someone else has conducted a domain name search on a registrar’s site, performed a WHOIS query or typed a domain in the browser to see if there is an active Web site. Front Runners may get access to these searches through Internet Service Providers, Spyware, or registries. Front Running allows these individuals to attempt to make money from the domain through pay-per-click ads or by re-selling the domain in the aftermarket at a marked up price.

Well, Network Solutions, just stop this Non-Sense. What you have been doing and are still doing has no difference at all. You lock the domain name right away after someone searched for it from your searching tool. You may say you are not making money from the domain through pay-per-click ads; okay, but you are displaying your own ads saying that this domain is available to purchase from your site, and by the way, are you saying that you are not displaying your own ads to be clicked? And you say that you are not monetizing the domain, but the person himself / herself is no longer able to purchase the domain from anywhere else except your site (note: before you start saying that it is only for up to 4 days, read on till the end of this article!). In fact, before the person made the searching in your searching interface, the domain was available to purchase from ANY registrar (and for the person’s registrar, it would only be around $9), but then you grabbed it, and froze it so the person would only be able to register it from your site at $34.99.

So, do you still remember your definition about Front Running? I will suggest you to re-read your own site then, Network Solutions.

And for the newcomers of domain registration world, welcome to the Non-Sense of Network Solutions awareness. I would like to advise you to be careful on using domain availability searching tool anywhere, do your prior research towards the whole site to make sure they don’t freeze your chosen domain after you have used their searching / whois tool to check the availability. Especially this tool of Network Solutions. If you don’t plan to purchase a domain name from any registrar (but from another one), don’t toy with the first one’s searching / whois tool. But if you insist on trying it, then try it at your own risk.

They may say: “A customer may phone Network Solutions customer support and request the domain name be released before the end of the reserve period.” But for International registrant candidates, that was just a non-sense to make an international call for just requesting the release of the ‘hostage’ since they were sure that they would never purchase the domain from this site, concerning the high paying difference of the price between $34.99 (Network Solutions) and $9 (their own registrar). Not to mention that the prices of ‘do-it-yourself’ and ‘do-it-for-me’ on the same searching page were misleading the people about the real price for purchasing the domain, and then they would end their search to sudden awareness that the real price for the domain name was $34.99. Now, tell me, how many people would still be ‘faithful’ to purchase when they found out the price?

And not to mention that third parties can now monitor lookups on NSI via the daily additions and deletions from the NSI nameserver by more malicious 3rd parties. So, if you don’t get it in 4 days, a squatter will notice the shown interest and know to register it themselves.

So, take heed to the warning again:

If you are not planning to register any domain name through Network Solutions (or any other registrar), never use their domain searching tools, do not ever toy with their domain searching tools, and I would not recommend you to use even their whois tool either.
However, if you have decided to purchase any domain name, make sure first about which registrar service you would use for the registration, and search the availability of your chosen domain name only from the chosen registrar, and don’t toy with other registrar’s tools (like this Network Solutions has).

Last Note:

Personally I don’t think that Network Solutions is the only one that implements this so called ‘Customer Protection Measure’. However, since the world wide web knows Network Solutions cases and the lawsuits against them, and how that they are still doing the same Non-Sense towards a naive newcomer (just re-read the point #5 above, it still happened again dated March 2, 2008), I decided to put this post up, so the others will also take note and then be careful next time.

इंटरनेट की वर्चुअल दुनिया में एक ही प्रकार की प्रापर्टी होगी है, डोमेन नाम। यह ठीक वैसे ही है जैसे आपने किसी शहर-गाँव में कोई ज़मीन खरीद ली या लंबी अवधि के लिए किराए पर ले ली। डोमेन नाम को आप खरीदते नहीं हैं वरन्‌ सालाना लीज़(lease) पर लेते हैं जिसके तहत आप प्रति वर्ष उसका भाड़ा चुकाते हैं ताकि वह डोमेन आपके पास बना रहे और आप उसका जैसे चाहें वैसे प्रयोग करते रहें। डोमेन नाम एक भू-खंड की तरह है और जो आप उस पर वेबसाइट बनाते हैं वह किसी इमारत की तरह जिसमें चाहे तो आप स्वयं रहें या उस इमारत को होटल या ऑफिस आदि में बदल उससे नोट कमाएँ।

ज़मीन खरीदने से पहले आप देखते हैं कि आपको कहाँ ज़मीन लेनी है, कौन सी जगह लेना सही रहेगा, कहाँ सस्ती और अच्छी मिलेगी। और फिर आप या तो सीधे ज़मीन के मालिक से खरीदते/किराए पर लेते हैं अथवा किसी दलाल के द्वारा। डोमेन लेने में भी कुछ-२ ऐसा ही होता है, आप ढूँढते हैं कि आपके मनपसंद नाम वाला डोमेन उपलब्ध है कि नहीं; यदि उपलब्ध है तो आप किसी एक दलाल(रजिस्ट्रार - registrar) से उसको किराए पर ले लेते हैं और यदि डोमेन उपलब्ध नहीं तो उसके मौजूदा मालिक से संपर्क कर उसको पाने का प्रयास करते हैं। यहाँ तक तो ठीक है, यह सामान्य प्रक्रिया है। यदि आपका वांछित डोमेन उपलब्ध है तो आप किसी भी रजिस्ट्रार से उसको ले सकते हैं और कोई बंदिश नहीं कि आपने जिस रजिस्ट्रार के द्वारा डोमेन ढूँढा उसी से आपको लेना होगा, परन्तु यदि जिस रजिस्ट्रार के द्वारा आपने डोमेन ढूँढा वह आपके ढूँढते ही उस डोमेन पर कब्ज़ा कर ले तो आपके पास फिर सिर्फ़ उसी रजिस्ट्रार से डोमेन लेने का विकल्प होगा। और इस बात की कोई गारंटी नहीं कि आपने यदि तुरंत डोमेन नहीं लिया और एकाध दिन बाद लेने आए तो वह रजिस्ट्रार उस डोमेन के आपसे ज़्यादा पैसे नहीं माँगेगा।

डोमेन नाम बेचने के धंधे में वैसे भी रजिस्ट्रारों यानि कि दलालों की उतनी कमाई नहीं रह गई है जितनी पहले हुआ करती थी। आज बहुत की कम मार्जिन पर रजिस्ट्रार डोमेन आगे ग्राहकों को दे रहे हैं क्योंकि गला-काट प्रतियोगिता है बाज़ार में। इसी के चलते ऐसे बहुत से रजिस्ट्रार हैं जो पहले बाज़ार के बड़े खिलाड़ी होते थे और आज जिनको पूछने वाला कोई नहीं क्योंकि उन्होंने अपने को बाज़ार में बनाए रखने के लिए अपने दाम कम नहीं करे हैं और पहले जैसे ही ऊँचे दाम बनाए रखे हैं। ऐसे ही गिरते रजिस्ट्रारों में से एक है नेटवर्क सॉल्यूशन्स जो कि शुरुआती दिनों में बहुत बड़ा फन्ने खाँ हुआ करता था लेकिन आज इसको कोई नहीं पूछता। क्यों? अरे जब दुनिया भर के रजिस्ट्रार पाँच-पाँच सौ रूपए में डोमेन दे रहे हैं तो कोई इससे तीन गुणा से अधिक दाम पर क्यों लेगा? आप कहेंगे कि सर्विस क्वालिटी तो जनाब इससे काफ़ी बेहतर सर्विस देने वाले रजिस्ट्रार इसके दाम के एक-तिहाई में डोमेन दे रहे हैं!! यह रजिस्ट्रार बाकी रजिस्ट्रारों की तरह आपको पाँच सौ रूपए प्रति वर्ष का भाव तब देगा जब आप इससे सौ वर्षों का अनुबंध करेंगे और पूरा भुगतान एडवांस में करेंगे। यदि आंकड़े कुछ कहते हैं तो यह देखिए:

इसमें नेटवर्क सॉल्यूशन्स तीसरे नंबर पर सिर्फ़ इसलिए बना हुआ है क्योंकि यह सबसे पुराने रजिस्ट्रारों में से एक है और शुरुआती दिनों में इसके द्वारा बहुतों ने डोमेन लिए थे। लेकिन अन्य कुछ आंकड़े तस्वीर साफ़ करेंगे।

निम्न सूचि दर्शाती है आज के समय के तेज़ी से बढ़ते शीर्ष 15 रजिस्ट्रार और उनके लाभ और हानि को

अब यह सूचि में आपको गोडैडी और इनोम रजिस्ट्रार शीर्ष पर ही दिखेंगे क्योंकि ये बाज़ार के साथ चलते हैं और सेवा की गुणवत्ता के साथ-२ अपने दाम भी बाज़ार के अनुसार रखते हैं इसलिए लोग इनसे लेना पसंद करते हैं। गोडैडी सीधे ग्राहक को बेचने में यकीन रखता है जबकि इनोम से आप सीधे खरीदें तो महँगा पड़ेगा लेकिन इसके विक्रेता दुनिया भर में हैं जिनसे आप काफ़ी सस्ते में खरीद सकते हैं। नेटवर्क सॉल्यूशन्स की खामी यह है कि उससे सीधी खरीद तो महँगी है ही, उसके विक्रेता भी उतने ही महँगे हैं क्योंकि वह विक्रेताओं को इतना मार्जिन नहीं देता कि विक्रेता खुद उसके रेट से कम में बेच सकें। अब यदि नेटवर्क सॉल्यूशन्स का हाल इस सूचि में देखना है तो वह निम्न है।

853वें स्थान पर मौजूद नेटवर्क सॉल्यूशन्स घाटे में है, यानि कि बाज़ार में उसका हिस्सा कम होता जा रहा है और उसके द्वारा रजिस्टर हुए डोमेन संख्या में कम होते जा रहे हैं। अधिक जानकारी हमको निम्न सूचि देती है।

इस आखिरी सूचि से अंदाज़ा होता है इस गिरते हुए रजिस्ट्रार के हाल का।

तो अब आप सोचेंगे कि यहाँ तक तो ठीक है, ऊपर-नीचे तो धंधे में लगा ही रहता है लेकिन इसका काला-बाज़ारी आदि से क्या लेना देना जिसका ज़िक्र मैंने पोस्ट के शुरु में किया था!! है, उसका ही संबन्ध लगता है अपने को तो। हर आईकान(ICANN) द्वारा सर्टिफाईड रजिस्ट्रार किसी भी डोमेन नाम को फोकट में अपने पास 3-4 दिन रख सकता है। वह चाहे तो इस अवधि के पश्चात डोमेन पर अपना हक छोड़ सकता है और इस तरह उसको कोई पैसे नहीं देने होंगे परन्तु यदि इस अवधि के बाद भी वह डोमेन नहीं छोड़ता तो डोमेन रजिस्ट्री को उसे उस डोमेन का शुल्क देना होगा। तो नेटवर्क सॉल्यूशन्स गेम यह खेल रहा है कि यदि आप कोई डोमेन नाम उसके पास ढूँढते हैं तो यदि वह उपलब्ध है तो नेटवर्क सॉल्यूशन्स उसको पकड़ लेता है जिस स्थिति में यदि आपको ढूँढे हुए नामों में से कोई नाम चाहिए तो वह आपको नेटवर्क सॉल्यूशन्स से ही लेना होगा और अन्य किसी रजिस्ट्रार से नहीं ले सकते!! यह नाम नेटवर्क सॉल्यूशन्स पूरे चार दिन तक पकड़ के बैठेगा और उसके बाद छोड़ देगा। और यदि आप एकाध दिन बाद ढूँढे गए नामों में से किसी को रजिस्टर कराने पहुँचते हैं तो यह इस बात का संकेत है कि वह डोमेन आपके लिए महत्वपूर्ण है, इसलिए नेटवर्क सॉल्यूशन्स उसके ऊँचे दाम भी माँग सकता है। साथ ही इस बात की कोई गारंटी नहीं कि वह इस तरह पकड़े गए नामों की सूचि आदि आगे किसी को नहीं बेच रहा।

डोमेन नामों की स्पेक्यूलेशन आदि और पकड़ के खरीद-फरोख्त करोड़ों रुपए सालाना का बाज़ार है। यह ठीक वैसा है जैसे भूमि व्यापार या कह लीजिए शेयर बाज़ार जहाँ आप अंदाज़ा लगाते हैं कि कौन सी जगह पर कौन सा भूमिखंड अथवा कौन सी कंपनी का शेयर ऊँचा उठेगा और कितना उठेगा और उसके अनुसार आप खरीद-फरोख्त करते हैं ताकि दाम ऊँचा होने पर बेच सकें। डोमेन का व्यापार भी कुछ ऐसा ही है, डोमेन व्यापारी दम-खम रखने वाले अच्छे नामों को खोजते हैं और उनको रजिस्टर कर लेते हैं और फिर उनको ऊँचे दामों में बेचते हैं और जब-तक अपने पास रखते हैं तब तक उनसे विज्ञापनों आदि द्वारा कमाई भी करते हैं।

अभी तक नेटवर्क सॉल्यूशन्स पर सिर्फ़ शक जा रहा था कि वह अपने यहाँ ढूँढे गए नामों को पकड़ के बैठ रहा है लेकिन अब साफ़ हो गया है जब वह सीधे ही सीना ठोक के हामी भरता है कि वह ऐसा कर रहा है (अंग्रेज़ी में खबर यहाँ पढ़ें)। इस तरह 4-5 दिन के लिए डोमेन पर कब्ज़ा करने के बारे में आईकान(ICANN) की फिलहाल कोई स्पष्ट नीति नहीं है जो इस रजिस्ट्रार को या ऐसे किसी अन्य रजिस्ट्रार को रोक सके। कहने को तो इस विषय पर नेटवर्क सॉल्यूशन्स के नीति बनाने वाली समिति के उप-अधिपति(Vice President of Policy), जॉनथन नेवेट्ट, ने कहा कि उनका इरादा सिर्फ़ इतना है कि यदि कोई ग्राहक अपने लिए डोमेन खोजता है और एकाध दिन बाद आकर उसको पाने की कोशिश करे तो उसको वह प्राप्त हो सके और कोई अन्य उसको न ले उड़े (अंग्रेज़ी में खबर यहाँ पढ़ें) लेकिन यह महज़ एक बकवास के अतिरिक्त और कुछ नहीं है। डोमेन रजिस्ट्रेशन पहले आया पहले ले गया (First Come First Served) की तर्ज पर होता है, यदि आपके किसी ट्रेडमार्क का डोमेन नहीं है तो आपके खोजने भर से ही आपका उस पर हक नहीं हो जाता कि कोई और न ले सके। और नेटवर्क सॉलूशन्स की ओर से यह बकवास ही है कि वे अपने ग्राहक के लिए डोमेन सुरक्षित कर रहे हैं ताकि दोबारा आने पर उनको मिल सके, क्योंकि कोई गारंटी नहीं है कि कोई अन्य व्यक्ति आकर उनसे डोमेन नहीं ले जाएगा!! वे सिर्फ़ अनैतिक तरीके से अपनी दलाली सुरक्षित करने का प्रयास कर रहे हैं; डोमेन चाहे कोई ले जाए लेकिन उन्हीं से लेकर जाए और रोकड़ा उनकी जेब में ही आए!!

यह तो सीधे-२ अपनी ताकत का गलत लाभ उठा बाज़ार में अपनी दलाली जबरन हासिल करने का एक टुच्चा तरीका है जो कि एक तरह से इस ओर लोगों का विश्वास मज़बूत ही करता है कि नेटवर्क सॉल्यूशन्स वाकई तेज़ी से नीचे जा रहा है और इसी के चलते तरह-२ के हथकंडे अपनाने से परहेज़ नहीं करेगा। साथ ही वह ग्राहकों पर से अपना विश्वास समाप्त कर रहा है, इस बात की क्या गारंटी रह जाएगी कि कल को वह किसी के डोमेन में घपला नहीं कर देगा? आईकान(ICANN) की नीतियों में बहुत लफ़ड़े हैं बहुत झोल हैं और कोई भी समझदार उनके दाएँ-बाएँ जाकर अपना उल्लू सीधा कर सकता है। और जो एक बार गलत कार्य कर सकता है वह पुनः भी कर सकता है, नेटवर्क सॉल्यूशन्स ने यह तो दिखा ही दिया कि वह एक गलत कार्य कर रहा है और सीना ठोक के कर रहा है क्योंकि कानूनी रूप से उसको फिलहाल कोई रोक नहीं सकता!!

De registrar Network Solutions misbruikt zijn whois-service om opgezochte en nog vrije domeinnamen gelijk te locken, zodat ze bij andere aanbieders als onbeschikbaar getoond worden. Weliswaar duurt die initiële lock normaal gezien maar 5 dagen, maar zekerheid dat het domein weer vrij komt heeft de gegijzelde koper niet - en kan dus niet anders dan voor Network Solutions kiezen als hij het domein koste wat het kost wil hebben. En opgelet: de standaard whois van linux gebruikt whois.networksolutions.com.

Er volgende wel een officieel antwoord, maar zuiver op de graat is deze praktijk niet te noemen. Front running, daar lijkt het inderdaad op.

I began the process to register it at GoDaddy, but decided to come back to it later after I had asked a Russian friend of mine if it was the correct and most popular translation for "brides". Today, I went back to check the availability and невест.com was registered on December 27th, 2007 to a person who's name doesn't appear even once under a Google search. I called the listed phone and it is "Temporarily Disconnected".

Coincidentally, the address listed for the domain registration is 26 minutes from GoDaddy's headquarters.

It was best not to register the name, because as my Russian friend clarified, the correct translation is невеста, ending "a" and невесты is the plural form. Both of the correct translations were registered a few years ago.

And in this case it did.

As reported on many other blogs today, Network Solutions automatically does the following (without ANY warning) after you use their site to check the availability of any domain name ending in .com (try it now, before they've refined their script to exclude domains that are too long for example - that would spoil the fun):

a) they register the domain within seconds, in the name of a registrant called "This Domain is available at NetworkSolutions.com" (does a company by that name really exists as of Jan 8, 2008?);

b) within minutes they put up a NetSol ad-filled web page telling anyone who visits that this domain is available at Network Solutions (for $34.99, unless you also buy hosting or otherwise negotiate a better deal);

c) they automatically stop other registrars from being able to offer you much lower prices (in most cases in the range of $7.15-$9.95) for the same domain - since it's already registered by Network Solutions;

d) they automatically drop the domain in 4 to 5 days (without paying anything for the registration, using a procedure meant to allow registrars to refund their customers for mistyped domains) if you don't give in to the temptation to pay $34.95 or otherwise acquire it from them;

e) even if you're not unlucky enough to find that another person has buught the domain from NetSol in these 4-5 days, when they drop the registration they expose you to the serious risk of loosing your domain permanently to the multiple professional 'domain tasters' and other parties who usually register dropped domain names within a very short period of time.

The most unsettling part is that NetSol now defend their actions in terms that make me believe they seriously underestimate the IQ of the average domainer:

This is a quote attributed to Jonathon Nevett, Vice President of Policy at Network Solutions - courtesy of Circle ID:

“I’d like to clarify what we are doing. In response to customer concerns about Domain Name Front Running (domains being registered by someone else just after they have conducted a domain name search), we have implemented a security measure to protect our customers. The measure will kick in when a customer searches for an available domain name at our website, but decides not to purchase the name immediately after conducting the search.

After the search ends, we will put the domain name on reserve. During this reservation period, the name is not active and we do not monetize the traffic on these domains. If a customer searches for the domain again during the next 4 days at networksolutions.com, the domain will be available to register. If the domain name is not purchased within 4 days, it will be released back to the registry and will be generally available for registration.

This protection measure provides our customers the opportunity to register domains they have previously searched without the fear that the name will be already taken through Front Running.

You are correct that we are trying to take an arrow out of the quiver of the tasters. As you know, domain tasters are the largest Front Runners. Due to no fault of registrars, Front Runners purchase search data from Internet Service Providers and/or registries and then taste those names. Some folks may not agree with our approach, but we are trying to prevent this malicious activity from impacting our customers.”

I am speechless...

Le SSAC prend bien garde de souligner qu'il existe de nombreux moyens par le biais desquels le Front Running pourrait exister, allant d'un virus "renifleur" planqué sur la machine d'un utilisateur au fournisseur d'accès qui revendrait illégalement les recherches des utilisateurs de son réseau.

Mais, précise le SSAC, il peut aussi s'agir de coïncidences puisque jusqu'à maintenant, personne n'a jamais été en mesure d'apporter la preuve d'un cas concret de Front Running. "Néanmoins, il existe chez certains déposants de noms l'impression que le processus d'enregistrement d'un nom de domaine est parfois détourné pour faire du Front Running," précise le SSAC. "Il est donc dans l'intérêt de la communauté du nommage de s'assurer que cette impression ne se transforme pas sans fondement en certitude."
